As of March 16, 2020, the State of Georgia adopted a program referred to as Employer-Filed Claims (EFC). Experian Employer Services outlined the program here. In summary, the program “mandates all Georgia employers to file partial claims online on behalf of their employees for any week during which an employee (full-time/part-time) works less than full-time due to a partial or total company.”

It has come to our attention that the State of Georgia’s Employer-Filed Claim Program “has been reinstated with more stringent security measures to enhance the validity of personal and payment information used to determine entitlement to unemployment benefits,” as stated by the State of Georgia in their email Employer-filed (Partial) Claim Program Updates.

It is important to note that “Employers may only submit EFCs for full-time employees (30 hours or more) working less than full-time due to lack of work only and earns an amount not exceeding his/her unemployment insurance weekly amount plus the earnings allowance of $150.”

How does this affect employers?

As much as the state of Georgia has allowed for more transparency into employee claims via their Employer Portal, the bigger point to note is that employers are now required to provide DOL-5198 or the Employer-Filed (Partial) Claim Employee Instructions, to claimants in the event of a layoff or shut down.
