It is very important that you, the employer, apply your policy the same to all employees regardless of the situation. At times it can be difficult due to circumstances beyond your or the employee’s control, or that you just want to be the nice guy or gal. However, not applying the policy the same to everyone every time will lead to a lost unemployment claim. The state views how the employer applies its policy to each person. If you are not applying the policy the same to everyone, then the policy has little power, as you will.

The lack of consistency with any policy turns the policy into a general rule and not a statement of fact that the employee must follow. For example, if your policy states that any employee having six attendance points will be discharged and should receive at least one warning, then that is precisely what should be done. If you allow the employee to work past six points or fail to provide the one warning as stated, then your policy is more of a guideline and not a policy. Failure to follow one’s policy can have an impact on all policies being considered a general rule and not a statement of fact.

Remember, stick to your guns with your policy and treat every policy the same for every employee regardless of the situation.
