The state of Florida has a rule in place to help protect the employers during the early stages of a new hire’s career with their organization. Within the first 90 days of a new hire’s employment, the employer has the right to terminate the employee for any situation (not related to lack of work or plant closures) and at any time within that 90-day period. The employer’s state unemployment tax account will not be charged for any benefits claimed by this recently let go new hire.

The employer must make the new hire aware of this regulation within the first seven days of their hire date, so it is vital to include this during the onboarding process. The state’s idea behind this rule is that an employer should know after a full three months of employment if a new hire will be successful in this role and an asset to their company. If the 90-day period passes and the new hire is still with the company, then any termination aside from misconduct could be considered by the state if the employee leaves their job and files for benefits.
