Effective January 1, 2022, via SB 564, North Carolina is enacting the “North Carolina Paid Family Leave Insurance Act.” The Act is intended to provide North Carolina’s Workforce an assured 12 weeks of PTO for significant life events. The employee will receive 1 hour of PTO per 30 hours worked. They can receive up to 100% of the statewide average wage per week if eligible.

This measure provides that any person who submits an application and meets the monetary eligibility criteria regarding unemployment benefit claims or meets one of the requirements below:

  • is caring for a new child during the first year after birth, adoption, or child placement
  • is caring for a family member with a serious health condition
  • has a serious health condition
  • is caring for a covered servicemember, as defined, who is the covered individual’s next of kin or other family member
  • because of any qualifying exigency leave (as defined) arising out of the fact that the family member of the covered individual is on active duty or has been notified of an impending call or order to active duty in the Armed Forces.
