SB 5193 – An Act Relating To Unemployment Insurance Claim Adjudicators

SB 5193 is intended to create a reserve force of unemployment claim adjudicators.

This measure requires the Employment Security Department (ESD) to create a training program to train qualified persons to perform as unemployment insurance claim adjudicators. It also mandates the Office of Financial Management assists ESD in identifying agencies with state employees who meet minimum qualifications to be an adjudicator. The measure will require ESD to assure written communications are tested.

What does SB 5193 mean for employers? 

In the event of any further large influx of claims, Washington is passed a measure that will require that additional staff be allocated to address the claim load. This will likely assist in the quality and time spent processing a claims load similar to what was seen during COVID-19.

SB 5478 – An Act Relating To Unemployment Insurance Relief For Certain Employers

As noted in the legislature, this is intended “to preemptively minimize the disproportionate impact COVID-19 economic closures have had on [certain] businesses.” The legislature is set to provide relief of benefit charges to the businesses’ experience rating account.

The measure creates four categories of employers eligible for forgiven benefits, rather than two, that: (1) Include categories limited by lower size thresholds; (2) Include somewhat different industries in the industry-limited categories; (3) Use a higher minimum rate increase threshold; and (4) Are eligible for different portions of total available funding.

The deadline for the calculation of forgiven benefits will be December 20, 2021, for all categories. The total available funding available will be $500,000,000. It will require the ESD to provide annual outreach and assistance to employers delinquent in payments.

What does SB 5478 mean for employers? 

SB 5478 will provide additional benefit charges relief to applicable businesses.
