West Virginia has presented the Unemployment Insurance Program Integrity Act (referred to as the Act) to Governor Jim Justice for signing. The Act is intended to assist the WV Commissioner in pursuing and seeking repercussions for fraud, as well as assisting employers in reporting fraud to Workforce West Virginia.

The Act is intended to require that the Unemployment Commissioner: 
(a) Check existing claimants against the Division of Corrections and Rehabilitation’s list of imprisoned individuals to verify a claimant’s eligibility for unemployment benefits
(b) Check new hire records against the National Directory of New Hires to verify eligibility for unemployment benefits
(c) Check the unemployment insurance rolls against a commercially available database that provides crossmatching functions to verify eligibility for unemployment benefits

The commissioner will also be implementing internal policy to:
(a) Pursue the recovery of fraudulent unemployment overpayments to the fullest extent under state and federal law
(b) Enter into a cooperative agreement with the U.S. Department of Labor Office of Inspector General to proactively detect and investigate cases of unemployment fraud
(c) Recover improper overpayments of unemployment benefits

This Act also allows Employers to contact Workforce West Virginia by email, telephone, or any other method of communication to report a refusal to return to work.

This Act will take effect July 1, 2022. Corporate Cost Control will keep you posted on when Governor Jim Justice signs this Act.
