Kentucky: Last week CCC released a bulletin detailing the opinion released April 26, 2019. In this ruling,  the Kentucky Court of Appeals held the longstanding Kentucky law allowing a non-lawyer to represent a business entity at an administrative unemployment hearing is unconstitutional.

CCC is working closely as a member of the Association of Unemployment Tax Organizations (AUTO) in conjunction with the President of the UWC, Doug Holmes to hopefully overturn this ruling.  CCC has received notice that the Kentucky UI Agency has decided to file a petition for rehearing at the KY Court of Appeals. The head of the agency’s legal team, Ms. Bridget Papalia, is in full support of maintaining the ability of lay people representing any party at all levels of an unemployment claim.

Depending on the outcome of the agency’s petition, the next step will be for the agency to file a Motion for Discretionary Review with the Kentucky Supreme Court.  At either stage(petition for rehearing and/or Motion for Discretionary Review), the agency may request amicus support from interested parties and all AUTO members and the UWC are fully prepared to provide such support.

Louisiana: The Louisiana Unemployment Insurance Trust Fund, which is administered by the Louisiana Workforce Commission, surpassed the $1 billion, the highest the fund has been since 2009. Louisiana’s employers pay into the trust fund and in turn, these funds are used to pay unemployment benefits to eligible claimants.
