Document, document, document . . . Start a paper trail, so that employees know exactly where they stand. Protesting an unemployment claim may seem like a straightforward process, but it can be very grey as the rules that apply vary from state to state. This leaves a lot of room for interpretation, and that is why documentation is so important.

As an employer, you want to set up solid policies. These can be included in your company handbook where the employee’s sign for it upon hire and as it is updated make sure they sign for the updated copy as well. You’d be surprised the number of people that forget company policies when unemployment becomes involved! Protect yourself by ensuring you have proof they were made aware of all policies and procedures.

When you are disciplining an employee, it is important to give a direct and detailed warning to spell out beyond a doubt what has transpired.  Be sure to write your warning so the reader can create a clear picture of what occurred because this will be the case if reviewed much later.  A warning should also include what the employee should do next to resolve the issues and what will happen the next time this behavior occurs. Leave no room for interpretation! And again, have the employee sign the warning. (If they refuse, get a witness!)

When an employee resigns, to qualify for unemployment benefits,  they must prove they lost their job through no fault of their own. Having the proper documentation can prevent the shift of responsibility to your company. A resignation letter, the grievance policy, and an exit interview are just a few documents that as an employer you can provide to the state unemployment agency.
