But not when it comes to appealing an unfavorable determination.

Situation – You just received an unemployment determination that states that your former employee is eligible for unemployment benefits because you did not provide timely or adequate information in your response to the request for separation information.  You don’t understand how this could be. You responded to the unemployment claim prior to the due date stating that the employee was discharged due to violating a company policy. How could the State rule against you? You want to appeal this unfair determination.

Explanation – You lost this case because you did not provide all details and supporting documentation to prove that your former employee was discharged due to misconduct. You did not provide the following information with your response to the unemployment claim:

Under UI Integrity law, all States now require that you provide full details when responding to an initial unemployment claim. You, the employer, are required to supply all documentation and information that you had on hand at the time you decided to discharge the employee. Providing just a summary of why a person was terminated rather than all the details is considered an inadequate response. Appealing such a determination is considered a violation of the UI Integrity law and will prevent you from prevailing at an unemployment hearing.

Advice – The next time you receive an unfavorable determination ask yourself if you provided full details and supporting documentation surrounding the employee’s separation from employment before going forward with an appeal.  Don’t let your emotions get the best of you when deciding whether to appeal. Follow your head…not your heart!
