In February 2017, Corporate Cost Control answered an employer question regarding states which required Separation forms prior to the workforce processes. (See the CCC Separation Forms by State chart)

One state where this practice is especially important is in the state of Louisiana. CCC provides all clients holding business in LA with a LWC-77 form. When an employee separates from their employer, the employer is  required  to fill out the LWC-77 and return it to the state and claimant within 72 hours of the separation.

So, where is this most applicable in the unemployment process? In hearing Coordinator Joe Turner’s experience, LWC-77 is most applicable to base-period separations and chargeability cases. In Louisiana, chargeability cases are generally based on three factors:

  1. Establishing a disqualifying separation
  2. Timely response to the unemployment claim,
  3. Form 77 being submitted to the state and claimant within 72 hours.

If we cannot provide proof to all 3 factors, then the employer will be charged.

Please note, LWC-77 is not a form that can be filled out by Corporate Cost Control or any employee leasing firm. More often than not, CCC or an employee leasing firm will not have notice of a separation within 72 hours, and therefore cannot meet the 3-day deadline upheld by the state.
