Prepared ConceptAt CCC we prefer to promote from within.  What this means is CCC cultivates a team that understands all aspects of unemployment insurance. The thing that makes CCC very different is that all of our employees who have previously worked in the hearings department, continue to represent our clients in unemployment hearings as part of our current positions.  That means even as an Account Executive; I work with clients to ensure they receive a great hearing experience.  I thought this month; I would review how to best prepare for a hearing if you don’t have a CCC representative.

The first step in preparing for an unemployment hearing is to identify who the appropriate witness(s) would be to attend the hearing.  The best witness(s) would be those who have direct firsthand knowledge of the final incident that led to separation as well as prior incidents that may have occurred.  At times more than one witness may be needed as a result.

When preparing for a hearing you should make sure to have a copy of the hearing notice and file which should include any and all prior documentation provided to the state agency at the claim level and in certain states will include the claimant’s statements.  In discharge cases, I recommend organizing a timeline of events and details starting with the incident that resulted in termination and worked back in reverse chronological order of prior warnings/write-ups the individual may have received.

If the hearing file includes the claimant’s statements, it is best to review thoroughly to see if there are any other items/documents you may need to present as well as any additional witnesses.  This is also a good time to prepare any rebuttal testimony that you may have to provide based on the claimant’s statements.
